When you need software built, you'll quickly face a choice: hire a freelance developer, or engage an SSM-registered company. Both can write good code — but they differ a lot in accountability, continuity, and how protected you are if something goes wrong. Here's what actually matters.

What's the difference?

An SSM-registered business is formally registered with the Companies Commission of Malaysia (Suruhanjaya Syarikat Malaysia). It has a registration number, a legal identity, and legal obligations. A freelancer is an individual working independently, often without a registered business entity.

The gap that matters to you isn't skill — plenty of freelancers are excellent — it's accountability and continuity. A registered company can sign enforceable contracts, issue proper invoices, and be held responsible as an entity; an individual is a single point of failure.

Why does SSM registration matter for a software project?

For anything business-critical, registration gives you real, practical protections:

  • A verifiable legal entity you can check and hold to a contract.
  • Proper invoicing and records — important for your own accounting and tax.
  • Continuity — a company usually has more than one person, so your project doesn't stall if one developer disappears.
  • Clearer recourse if the work is defective or incomplete.

None of this guarantees good work on its own — but it removes a whole category of risk before you even start.

What are the risks of hiring an unregistered freelancer?

Freelancers can be a great fit (more on that below), but the common failure modes are worth knowing:

  • Single point of failure. If they fall ill, get a full-time job, or simply go quiet, your project can stop dead.
  • Weaker contracts. Informal arrangements make disputes harder to resolve.
  • IP and handover gaps. Without a clear agreement, ownership of the code and access to accounts can get messy.
  • Limited capacity. One person can only cover so many skills — design, backend, mobile, DevOps, security.

When is a freelancer the right choice?

Freelancers are often the better choice for small, well-defined, low-risk tasks: a quick landing page, a small feature, a design mockup, or a short-term boost to an existing team. If the scope is contained and you can tolerate some continuity risk, a good freelancer is fast and cost-effective. The mismatch happens when a business hands a long-term, business-critical system to a single freelancer and later needs support, changes, or someone to take over.

How do you verify a software vendor in Malaysia?

Whether company or freelancer, do these checks before you commit:

  • Confirm SSM registration — ask for the registration number and verify it via SSM's official search (e-Search / MyDATA).
  • Get a written contract covering scope, milestones, and payment.
  • Confirm IP ownership — you should own the source code and IP on final payment, in writing.
  • Review real, relevant work and, ideally, speak to a past client.
  • Agree a support plan for after launch.
  • Check communication quality during the sales stage — it rarely improves later.
